Amendment Proposed To California Hazardous Waste Generator and TSDF Training

The California Department of Toxic Substances Control (DTSC) has proposed revisions to the state’s unique Title 22 hazardous waste facility requirements. In addition to permitted treatment, storage & disposal facilities (TSDF) portions also apply to large quantity generators (LQG) of hazardous waste in the State.

The proposed hazardous waste revisions include a new reporting requirement; by March 1 each year, hazardous waste generators will be required to submit a report to DTSC that certifies that every employee has been trained on all requirements applicable to his or her job. The proposed revisions will also require employers to keep employee-signed or -certified hazardous waste training records on site and makes numerous changes to the training content required.

Metal Plating Operation Required To Have Total Organic Spill Plan

Project: Total Toxic Organics Management Plan For Metal Finisher
Client: Metal Finishing Company

Key Elements: Total Toxic Organics Management Plan, SPCC Plan


Overview: This metal finishing was subject to Categorical Effluent Guidelines. In lieu of monitoring wastewater discharges for the full list of “Total Toxic Organics” the facility opted to prepare and implement a Total Toxic Organic Management Plan (TTOMP) for the site. Caltha was contracted to prepare the TTOMP for the facility. The TTOMP included:
• Inventory and description of TTO compounds used in the electroplating or finishing processes, and degreasing processes;
• Inventory and description of regulated processes where TTO compounds are used;
• Description of disposal methods for materials and wastes that contain TTO compounds;
• Description of controls used to limit or eliminate the discharge of TTO compounds to the sanitary sewer.


The TTOMP was combined with a Facility Spill Plan which included processes and containers not specifically addressed under the Effluent Guidelines. Caltha prepared a spill control plan for the site to minimize and control spills from areas where liquids are stored, transferred and used. The spill plan included:
1. Inventory and description of chemical storage and process tanks;
2. Description of batch discharges to sanitary sewer;
3. Description of controls and procedures to prevent entry of chemicals and other restricted materials and wastes from entering the sanitary sewer;
4. Emergency notification procedures;

SPCC Plan Review | Five Year SPCC Plan Amendment

Overview: Caltha LLP was retained by this multimodal transportation terminal to conduct the five-year review of its Spill Prevention, Control & Countermeasure (SPCC) Plan. Under 40 CFR 112, SPCC Rule regulated facilities are required to conduct and document a review of their SPCC Plan at least every five years, independent of the requirement to keep the facility SPCC Plan updated to reflect changes at the facility. In conjunction with this review, Caltha staff provided ad hoc compliance training to selected facility staff on SPCC Rule requirements. Finally, Caltha prepared an updated facility SPCC Plan to reflect administrative changes at the facility.

Overview: Caltha LLP was retained by this printing facility to assisting in preparing the air emission inventory report required by the Wisconsin DNR under their FESOP for VOC emitting equipment. Caltha staff reviewed operations and developed material usage tracking systems and monthly air emission estimate tracking sheets. The tracking system incorporated adjustments based on hazardous waste disposal records. This allowed the facility to comply with monthly recordkeeping requirements which were then available for annual air emission reporting using the WDNR on-line reporting system. Caltha provided training to facility staff on emission tracking procedures.

Ohio Revises Rules For Underground Storage Tanks

Ohio has changed its underground storage tank regulations to align with federal rules.Under Ohio Rule OAC 1301-7-9-06, all new UST Systems must have secondary containment. Previously, only UST Systems in sensitive areas had to secondary containment. Further, when the cumulative replacement of an existing UST system exceeds 50%, then the entire system must have secondary containment. When new dispensers are installed or when existing dispensers are repaired and did not have containment pans under the dispenser, containment must be then installed under the dispenser.

Under Rule OAC 1301-7-9-19, by August 8, 2012, Owners and operators had to designate, train and document the training of Class A, B and C operators. This training was for operators of UST systems and is in addition to the licensure requirements for UST installers. Licensed UST installers automatically qualify as Class A operators.

Class A Operators have the primary responsibility for achieving and maintaining compliance with statutory and regulatory requirements and standards necessary to operate and maintain the UST system at one or more UST Sites. Class B Operators have the primary responsibility for implementing applicable requirements and standards for UST systems at one or more UST sites. Class A and B Operators have to undergo training from a state Fire Marshal approved trainer using formats approved by the state.

Class C operators (often being at least one attendant at the facility during working hours) are responsible for the initial response to alarms and other indications of emergencies caused by spills or releases from a UST system and for notifying the Class A or Class B Operators or emergency response personnel of the same. Class C operators may be trained by Class A or Class B operators using formats approved by the state.

The North Star Chapter of the Alliance of Hazardous Materials Professionals (AHMP) is announcing its August General Membership Meeting. This month’s meeting focuses on indoor air quality topics and adjustments to air handling systems to improve performance.

Presentation will provide insight on recommissioning (renovating) of ventilation systems to improve air quality and energy performance. Discussion will include benefits and cost effective action items building owners and operators could consider to improve the indoor environment, as well as see benefits in energy efficiency.

OSHA Announces Final HazCom 2012 Rule and Compliance Dates

On a teleconference call, OSHA announced the revision to the Hazard Communication Standard (HCS) as well as related compliance deadlines affecting chemical manufacturers, distributors and employers. According to OSHA the Final Rule will be filed on March 20th at the Office of the Federal Register and available for viewing on their Public Electronic Inspection Desk. The Federal Register will publish the final rule on March 26, 2012. The effective date of the final rule is 60 days after the date of publication.”

The revised HCS, which OSHA is calling HazCom 2012, is expected to affect every U.S. workplace with exposure to hazardous chemicals, and is estimated to cover over 5 million facilities and over 40 million workers. The first compliance date employers should be aware of is December 1, 2013, which is the date by which employees must be trained on the new label and SDS formats. OSHA is now calling this standard the “Right to Understand” updating the “Right to Know” concept behind the former HCS.

Final IUR - Chemical Data Reporting Rule - IUR Reporting Restarted

The U.S. Environmental Protection Agency has finalized the revised rule for reporting the manufacture and import of chemical substances under the Toxic Substances Control Act (TSCA), as required under 40 CFR 710 and Section 8(a) of TSCA. This rule has commonly refereed to as the Inventory Update Reporting rule, or IUR. The revised rule, known as the Chemical Data Reporting Rule (CDR), also requires that companies submit the information electronically to EPA, rather than on paper, and limits confidentiality claims by companies. Reporting for 2010 under the IUR was originally required to be submitted between June – September 2011; however, because the revised rule had not been completed, EPA temporarily suspended reporting requirement.

The CDR Rule, which falls under the Toxic Substances Control Act Inventory Update Rule (IUR), requires more frequent reporting of critical information on chemicals and requires the submission of new and updated information relating to potential chemical exposures, current production volume, manufacturing site-related data, and processing and use-related data for a larger number of chemicals. EPA is requiring companies to submit the information through the Internet, using EPA’s electronic reporting tool.

Companies will be required to start following the new reporting requirements in the next data submission period, which will occur February 1, 2012 to June 30, 2012.

Notice: For many companies that manufacture chemicals, or that import chemicals for their own use or for further distribution, the IUR (now CDR) reporting requirements are the most significant compliance requirement under TSCA affecting their operations. Because the IUR reporting requirements cycle every five years, many companies need to “relearn” the reporting requirements in advance of a reporting year.

Caltha LLP will be conducting a TSCA Compliance Training Session, with an emphasis on the new Chemical Data Reporting Rule, in October 2011. This TSCA training is intended for corporate and facility environmental compliance staff, product responsibility/product stewardship coordinators, and staff involved in purchasing or arranging imports of chemicals from foreign suppliers, and other staff involved in TSCA compliance.

Training Requirement Deadline Extended For Lead Renovation, Repair & Painting Rule

In April 2008, EPA issued the Lead Renovation, Repair and Painting (RRP) Rule, which required the use of lead-safe work practices in pre-1978 homes but included the opt-out provision. Subsequently, EPA issued a new rule that removes a provision from existing regulations that allowed owner-occupants of pre-1978 homes to “opt-out” of having their contractors follow lead-safe work practices if there were no children under six years of age in the home.

The RRP rule requires certification of training providers and lead-safe work practice certification for individuals involved in the construction and remodeling industry. Because of concern that contractors in some areas may be having difficulty accessing training classes, EPA recently announced that it is providing renovation firms and workers additional time to obtain training and certifications to comply with the new lead rules. EPA will not take enforcement action for violations of the rule’s firm certification requirement until October 1, 2010, and will not enforce certification requirements against individual renovation workers if they apply to enroll in certified renovator classes by September 30, 2010 and complete the training by December 31, 2010.

The agency has indicated that it will continue to take enforcement actions against renovation firms and individuals who do not comply with the RRP work practices and associated recordkeeping requirements. The lead-safe work practices include dust control, site clean up and work area containment.

The North Star Chapter of the Academy of Certified Hazardous Materials Managers (now "Alliance of Hazardous Material Professionals") provides an annual regulatory overview course for environmental, health & safety professionals.
